A public hearing was conducted on a proposed resolution on issuance of a corrective quit claim deed to Michael R. Pillard, Executor of the Roy George Pillard Estate. No comments or objections were heard. Motion by Bockenstedt, seconded by Keehner, to approve resolution # 28-2007 regarding issuance of a quit claim deed to Michael R. Pillard, Executor of the Roy George Pillard Estate. Ayes: Gibbs, Bockenstedt, Keehner
Resolution # 28-2007 WHEREAS, Clayton County, acquired a property interest to the following described real estate:
Lot Five (5) of Lot One (1) of the Lot Three (3) in Section 15, Township 95, North of Range Three (3) West of the 5th P.M. in the town of Marquette, in Clayton County, Iowa
WHEREAS, a deed with an erroneous description was first recorded on May 11, 1950, to Merl Sawvell and needs to be corrected,
WHEREAS, in accordance with Chapter 331.361(2) of the CODE OF IOWA, 2007, notice of a public hearing is published in the Outlook on October 3, 2007, for a hearing to be held on October 10, 2007,
THEREFORE BE IT RESOLVED by the Board of Supervisors of Clayton County, Iowa, that the Board Chairman, Larry Gibbs, and County Auditor, Dennis Freitag, be authorized to execute a Quit Claim Deed to Michael R. Pillard, Executor of the Roy George Pillard Estate and an affidavit explanatory of title for said real estate.
Motion by Keehner, seconded by Bockenstedt, to approve the quarterly fee reports of the Auditor, Recorder, and Sheriff. Ayes: Gibbs, Bockenstedt, Keehner
Motion by Keehner, seconded by Bockenstedt, to approve resolution # 29-2007 regarding embargoing portions of Kittyhawk and Kimberly Avenues. Ayes: Gibbs, Bockenstedt, Keehner Resolution # 29-2007 WHEREAS, the Clayton County Board of Supervisors is empowered under authority of Section 321 of the Code of Iowa to prohibit the operation of vehicles upon the highway or impose restrictions as to the weight of vehicles to be operated upon the highway for a total period not to exceed ninety days in any one calendar year, whenever the highway by reason of deterioration, rain, snow or other climatic conditions will be seriously damaged or destroyed unless the use of vehicles on the highway is prohibited or the permissible weights reduced. NOW, THEREFORE BE IT RESOLVED by the Clayton County Board of Supervisors that the county engineer be authorized to order Kittyhawk Avenue from city limits of McGregor to King Road and Kimberly Avenue from Business Highway 18 to King Road be embargoed to posted tonnages for the period of time starting October 10, 2007, and not to exceed 90 days, by erecting signs in accordance with Section 321.472.
A conference call with John Danos was held regarding Willmark Energy project in rural Postville. Minimum assessment agreements relating to tax abatement and tax increment financing were discussed. Decisions need to be made regarding what incentives are to be used for what actions are to be required of Willmark Energy.
Motion by Bockenstedt, seconded by Keehner, to approve resolution # 30-2007 regarding the approve of the final plat revision of Emerald Valley Estates. Ayes: Gibbs, Bockenstedt, Keehner

Accepting the revised final plat of Emerald Valley Estates Subdivision Phase 1
WHEREAS, there has been submitted to the Board of Supervisors of Clayton County, Iowa, a plat of real property hereinafter designated as Revised Final Plat of Emerald Valley Estates Phase 1 and described as: a subdivision of part of the NE ¼ SE ¼ of Section 9, part of the SE ¼ SE ¼ of Section 9, part of the NW ¼ NW ¼ of Section 10, part of the SW ¼ NW ¼ of Section 10, part of the NW ¼ SW ¼ of Section 10, and part of the SW ¼ SW ¼ of Section 10; all in Township 92 North, Range 5 West of the 5th P.M., Cox Creek Township, Clayton County, Iowa, WHEREAS, this is a revision of Lots 30, 31, 35, 36, 37, 40, 41, 42, 43, 44, and 94, WHEREAS, George Leonard as owner of said real property, has executed and acknowledged an instrument consenting to said plat, WHEREAS, it appears that said plat complies with all requirements of Chapters 354 and 355 of the Code of Iowa, WHEREAS, the Clayton County Planning and Zoning Commission has recommended approval of said subdivision, affirming that it has complied with all the regulations of Clayton County, Iowa, THEREFORE BE IT RESOLVED by the Clayton County Board of Supervisors that the Board approves as an official subdivision, the plat of real property to be known as Revised Final Plat of Emerald Valley Estates Subdivision Phase 1, (approximately 123.66 acres) situated in Clayton County, Iowa, and described as: a subdivision of part of the NE ¼ SE ¼ of Section 9, part of the SE ¼ SE ¼ of Section 9, part of the NW ¼ NW ¼ of Section 10, part of the SW ¼ NW ¼ of Section 10, part of the NW ¼ SW ¼ of Section 10, and part of the SW ¼ SW ¼ of Section 10; all in Township 92 North, Range 5 West of the 5th P.M., Cox Creek Township, Clayton County, Iowa.
