Meeting of the Board of Supervisors at their office, 200 E. Bridge St, Elkader, IA. Present: Larry Gibbs, Wayne Bockenstedt, Randy Keehner
The board approved claims for payment.
A public hearing on an animal confinement building construction permit for Joe Brandt in Section 12 of Garnavillo Township was held. Larry Stone was present to express his concerns. He was concerned that a manure management plan from a previous permit would be separate from this animal confinement. That distance was adequate and that ground water rules will be followed. He was able to inspect the construction permit application that was available for public inspection in the Auditor’s Office. Motion by Bockenstedt, seconded by Keehner, to close the public hearing. Motion by Keehner, seconded by Bockenstedt, to sign an acceptance of partial recovery on the Clayton County vs. Thornton, etal claim. Ayes: Gibbs, Bockenstedt, Keehner
The board met with Vicki Bloxham, Upper Explorerland Regional Planning Commission, to update them on the wastewater construction project at Scenic Acres’ lagoon.
County Sheriff, Robert Hamann, met with the Board to discuss contracting law enforcement with the cities without police departments in order for Sheriff Officers to enforce city ordinances that are not covered under state law.
A public hearing was held on the final plat of Green Wood Subdivision. No objections were heard. In attendance were Janet Ott, Zoning Administrator, and Terry Knickerbocker. The Planning and Zoning Commission had recommended that the final plat be approved. Motion by Bockenstedt, seconded by Keehner, to accept the final plat of Green Wood Subdivision by adoption of resolution # 15-2007. Ayes: Gibbs, Bockenstedt, Keehner

Accepting the final plat of Green Wood Subdivision
WHEREAS, there has been submitted to the Board of Supervisors of Clayton County, Iowa, a plat of real property hereinafter designated as Green Wood Subdivision and described as part of the S ½ of the NW ¼ and most of the SW ¼ all in Section 27, T91N, R5W, Lodomillo Township, Clayton County, Iowa,
WHEREAS, Kirsten Michelsen and Lynn Rowell as owner(s) of said real property, have executed and acknowledged an instrument consenting to said plat,
WHEREAS, it appears that said plat complies with all requirements of Chapters 354 and 355 of the Code of Iowa,
WHEREAS, the Clayton County Planning and Zoning Commission has recommended approval of said subdivision, affirming that it has complied with all the regulations of Clayton County, Iowa,
THEREFORE BE IT RESOLVED by the Clayton County Board of Supervisors that the Board approves as an official subdivision, the plat of real property to be known as Green Wood Subdivision, (approximately 172.5 acres) situated in Clayton County, Iowa, and described as: part of the S ½ of the NW ¼ and most of the SW ¼ all in Section 27, T91N, R5W, Lodomillo Township, Clayton County, Iowa,
Motion by Keehner, seconded by Bockenstedt, to adopt resolution #16-2007 regarding Clayton County’s Enterprise Zones. Ayes: Gibbs, Bockenstedt, Keehner Resolution #16-2007 A RESOLUTION OF CLAYTON COUNTY BOARD OF SUPERVISORS PETITIONING THE IOWA DEPARTMENT OF ECONOMIC DEVELOPMENT FOR EXTENSION OF CLAYTON COUNTY ENTERPRISE ZONES
WHEREAS, Clayton, Iowa, is an eligible “Enterprise Zone” county pursuant to 2005 Iowa Code Sections 15E.191 – 15E.196, and;
WHEREAS, Clayton County has successfully implemented tenets of the Iowa Enterprise Zone program, and;
WHEREAS, the Iowa Enterprise Zone program has proven of great benefit to businesses, individuals and citizens of Clayton County, Iowa, and;
WHEREAS, there has arisen a legitimate developmental need to extend the expiration deadline for, and stipulate relocation of, the amended Enterprise Zoned areas comprising of 5085.05 acres and certified by the Iowa Department of Economic Development, and;
WHEREAS, relocation and extension of Enterprise Zones is rendered possible via Senate File 2183: An Act Relating to the Certification of Enterprise Zones and Incentives and Assistance Under the Enterprise Zone Program and Including Effective Date and Retroactive Applicability Provisions, signed into law by Governor Thomas J. Vilsack on May 31, 2006, and;
WHEREAS, Iowa statutes confer responsibility for Enterprise Zone administration upon the Iowa Department of Economic Development.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of Clayton County, Iowa, hereby requests the following actions of the Iowa Department of Economic Development as authorized in 2005 Iowa Code Section 15E.192 and Section 15E, 194.
