Meeting of the Board of Supervisors at their office, 200 E. Bridge St., Elkader, IA. Present: Larry Gibbs, Wayne Bockenstedt, Randy Keehner
Motion by Bockenstedt, seconded by Keehner, to approve resolution # 4-2007 regarding vacating a portion of Oak St in McGregor Land Company’s Addition No. 1 to the Town of McGregor, Clayton County, Iowa. Ayes: Gibbs, Bockenstedt, Keehner
Resolution # 4-2007 WHEREAS, the Clayton County Board of Supervisors desires to vacate roads that are of little use to the public, and WHEREAS, Sections 306.10 through 306.14 of the Code of Iowa has been complied with and the hearing as required by law was held on February 14, 2007 (The original date for the hearing was February 7, 2007, but was postponed until February 14, 2007, because of extreme cold weather.) at 11:00 A.M. at the Supervisors Office in Elkader, Iowa, and WHEREAS, no objections have been received, either in writing or by persons present, NOW THEREFORE BE IT RESOLVED by the Clayton County Board of Supervisors that the following section of road be vacated: In the McGregor Land Company’s Addition No. 1 to the Town of McGregor, Clayton County, Iowa, that portion of Oak Street lying between the junction of Walnut Street and the south right of way line of 138th Street, between and by Lots 2,3,4,5,6 and a portion of 7 in Block 12, and Lots 1,2,3,4 and a portion of 5 in Block 11. Said street is 50 foot in width.
NOW THEREFORE BE IT RESOLVED by the Clayton County Board of Supervisors that said right of way heretofore described, together with any and all rights of Clayton County in and to the same are hereby abandoned and vacated and Clayton County disclaims any right, title or interest in and to said right of way or the use therof for any purposes whatsoever.
A public hearing on proposed resolution # 5 regarding sale of the property described and vacated in the resolution # 4-2007 was held with no objections heard. Motion by Keehner, seconded by Bockenstedt, to approve resolution # 5-2007 regarding the sale of the property described and vacated in the resolution # 4-2007. Ayes: Gibbs, Bockenstedt, Keehner
Resolution # 5-2007 WHEREAS, Clayton County, has a property interest to the following described real estate:
In the McGregor Land Company’s Addition No. 1 to the Town of McGregor, Clayton County, Iowa, that portion of Oak Street lying between the junction of Walnut Street and the south right of way line of 138th Street, between and by Lots 2,3,4,5,6 and a portion of 7 in Block 12, and Lots 1,2,3,4 and a portion of 5 in Block 11
WHEREAS, a public hearing was held on February 14, 2007 to vacate that part of Oak St previously mentioned and that part of Oak Street was vacated,
WHEREAS, the property has been deemed as surplus property and its best use would be attached to adjacent property to this property,
WHEREAS, Jeffrey J. and Tammy L. Kinley have offered to purchase the property for $100.00 plus all related expenses related to the sale,
WHEREAS, in accordance with Chapter 331.361(2) of the CODE OF IOWA, 2005, notice of a public hearing is published in the Monona Outlook on February 21, 2007, for a hearing to be held on February 26, 2007,
THEREFORE BE IT RESOLVED by the Board of Supervisors of Clayton County, Iowa, that the Board Chairman, Larry Gibbs, and County Auditor, Dennis Freitag, be authorized to execute a Quit Claim Deed to Jeffrey J. and Tammy L. Kinley for said real estate.
