Meeting of the Board of Supervisors at their office, 200 E. Bridge St., Elkader, IA.

Present:  Larry Gibbs, Wayne Bockenstedt, Randy Keehner

 

A public hearing was held on a road vacation of that portion of Oak St. lying between the junction of Walnut Street and the south right of way line of 138th St, between by Lots 2,3,4,5,6, and a portion of 7 in Block 12, and Lots 1,2,3,4, and a portion of 5 in Block 11 in the McGregor Land Company’s Addition No. 1 to the Town of McGregor, Clayton County, Iowa (but not inside the city limits of the City of McGregor).  The public hearing was at the request of Jeffrey  & Tammy Kinley.  No objections to the vacation of that portion of the street were heard.  Motion by Bockenstedt, seconded by Keehner, to vacate the previous described portion of Oak St.  Ayes:  Gibbs, Bockenstedt, Keehner

 

Darla Kelchen, Clayton County Development Group, was present to discuss a new industry proposal.

 

Motion by Bockenstedt, seconded by Keehner, to rescind the motion made on January 10, 2007, regarding funding for Helping Services in the fiscal year ending June 30, 2008.

Ayes:  Gibbs, Bockenstedt, Keehner

 

Motion by Keehner, seconded by Bockenstedt, to authorize the board chairman to sign the contract and bond for secondary road projects FM-CO22(47)55-22 and FM-CO22(48)55-22.  Ayes:  Gibbs, Bockenstedt, Keehner

 

Motion by Keehner, seconded by Bockenstedt to award pickup bids to Browns  for two 2007 Ford pickups F-250XL 4x4 with extended cabs with 8’ box for $24,602 and one with a 6’ box for $24,332.  Ayes:  Gibbs, Bockenstedt, Keehner

 

Motion by Keehner, seconded by Bockenstedt, to approve resolution #3-2006 regarding loss of federal entitlement benefits.  Ayes:  Gibbs, Bockenstedt, Keehner

 

Resolution #3-2007

Loss of Federal Entitlement Benefits

WHEREAS, U.S. Code of Federal Regulations, Title 42, Part 435.1009 states that federal financial participation (FFP) is not available in expenditure for services provided to individuals who are inmates of public institutions, and

WHEREAS, States being unable to assume the federal share of providing medical services to FFP eligible persons being held in county jails and detention facilities, tend to terminate or sometimes suspend eligibility, and

WHEREAS, this immediate cessation of benefits occurs prior to the issuance of formal charges or conviction, and

WHEREAS, counties must provide medical services to all persons incarcerated in local jails and detention facilities, and

WHEREAS, as the result of this regulation to immediately cease FFP for medical benefits, all costs of medical care must be borne solely by counties;

NOW THEREFORE BE IT RESOLVED that the Clayton County of Iowa Board of Supervisors requests and strongly urges Congress to amend necessary federal regulation to allow federal financial participation for medical benefits to incarcerated individuals until convicted and sentenced to secure detention.

 

A public hearing was held on a preliminary plat of Brimeyer Subdivision. In attendance were Janet Ott, Zoning Administrator, Aaron Schroeder and Neil Krieg.  No objections were heard.  Motion by Bockenstedt, seconded by Keehner, to approve the preliminary plat of the Brimeyer Subdivision.  Ayes:  Gibbs, Bockenstedt, Keehner

 

Phil Waniorek, J & W Insurance, Decorah, Iowa, made a health insurance presentation.
