Meeting of the Board of Supervisors at their office, 200 E. Bridge St, Elkader, IA.

Present:  Larry Gibbs, Wayne Bockenstedt, Randy Keehner

 

Consultation on urban renewal plan for ethanol plant was held for Northeast Iowa Community College and Postville Community School with neither party participating.

 

Sheriff Bob Hamann and Tammy Sylvester presented information relative to the potential financial losses to the County that are incurred when sheriff’s department employees misuse sick leave in order to exhaust it before retirement. Currently the sheriff’s department contract states that all sick leave will be forfeited at the time of retirement. No pay-out is currently available to union-covered employees. Hamann and Sylvester were seeking a letter of understanding amending the current contract to allow for some kind of payout in order to discourage this activity. Discussion followed. Bockenstedt made a motion to take sick leave reimbursement under advisement and to revisit the issue in the near future. Keehner seconded the motion. Ayes: Gibbs, Keehner and Bockenstedt.

 

Motion by Keehner, seconded by Bockenstedt, to approve resolution #34-2007 regarding the use of secondary roads for RAGBRAI and cyclists in general. Ayes: Gibbs, Keehner and Bockenstedt.

 

Resolution 34-2007

 

WHEREAS, the Register’s Annual Great Bike Ride Across Iowa (RAGBRAI) is a unique event that draws thousands of visitors to Iowa annually and promotes Iowa tourism; and

 

WHEREAS, biking in general is an excellent form of exercise enjoyed by millions of Americans, as well as a pollution-free form of transportation that should be encouraged; and

 

WHEREAS, secondary roads in Iowa are not designed or maintained to meet any specific standards related to bicycle travel; and

 

WHEREAS, the recent lawsuit against Crawford County involving the death of a RAGBRAI participant demonstrates the need to address the use of the county secondary road system by RAGBRAI and by cyclists in general; and

 

WHEREAS, the current situation has created an unacceptable exposure to future bicycle-related lawsuits against this County;

 

NOW THEREFORE, be it resolved by the Board of Supervisors that they respectfully request that the Iowa Legislature address this issue in 2008 on a statewide basis so that the Board of Supervisors does not have to act at the local level to regulate the use by cyclists of secondary roads under the jurisdiction of the County.

 

Motion by Bockenstedt, seconded by Keehner, to approve the final plat of the Christner Subdivision. Ayes: Gibbs, Keehner and Bockenstedt.

 

Resolution # 35-2007

 

Accepting the final plat of  Christner’s Subdivision

 

WHEREAS, there has been submitted to the Board of Supervisors of Clayton County, Iowa, a plat of real property hereinafter designated as Christner’s Subdivision and described as:  In the Southwest Quarter of Section 3, and the Northeast Quarter of Section 9, and the West Half of Section 10, Township 91 North, Range 4 West of the 5th P.M. Clayton County, Iowa,

 

WHEREAS, Amos Christner and Theresa Zuska Trust as owners of said real property, has executed and acknowledged an instrument consenting to said plat,

 

WHEREAS, it appears that said plat complies with all requirements of Chapters 354 and 355 of the Code of Iowa,

 

WHEREAS, the Clayton County Planning and Zoning Commission has recommended approval of said subdivision, affirming that it has complied with all the regulations of Clayton County, Iowa,

 

THEREFORE BE IT RESOLVED by the Clayton County Board of Supervisors that the Board approves as an official subdivision, the plat of real property to be known as Christner’s  Subdivision, (approximately 251.178 acres) situated in Clayton County, Iowa, and described as: In the Southwest Quarter of Section 3, and the Northeast Quarter of Section 9, and the West Half of Section 10, Township 91 North, Range 4 West of the 5th P.M. Clayton County, Iowa,

 

Bids were opened for the purchase of two motor graders. Motion by Randy Keehner, seconded by Wayne Bockenstedt to have Engineer Rafe Koopman compile the bids into a spreadsheet so that they can be evaluated on an equal basis according to specifications, attachments, etc. and then the supervisors will award the bid. Ayes: Gibbs, Keehner and Bockenstedt.

 

County Engineer Koopman requested the Board’s support of a letter that he will be sending out to secondary roads employees informing them of the procedure for awarding vacation time during times of possible inclement weather. Several of the county’s employees were granted time off recently and the county was then shorthanded during a major winter storm. Koopman will draft the letter for the Board’s review. The Board assured him of their support for this procedure.

 

The policy for replacement of mailboxes damaged by road crews during snow removal was reiterated. The County will pay for a standard 4x4 post and standard mailbox if the box is struck by equipment during snow removal.

 

Darla Kelchen, Clayton County Development Group, presented an Enterprise Zone Agreement for signature which was originally prepared in 2002, but was never signed. This agreement affects E-Ject Systems. E-Ject is currently being purchased by Caterpillar and it is being determined by legal counsel whether or not the Enterprise Zone can be transferred to Caterpillar as part of the sale.

 

Kelchen presented a preliminary budget request for 2008-2009.
