Meeting of the Board of Supervisors at their office, 200 E. Bridge St., Elkader, IA. Present: Robert Walke, Neil Meyer, Larry Gibbs
A public hearing was held on a proposed resolution to correct a sale of real estate to Eugene Knospe. Motion by Walke, seconded by Meyer, to approve resolution #16-2006 correcting a sale on August 25, 1982. Ayes: Walke, Meyer, Gibbs Resolution # 16-2006
WHEREAS, Clayton County, acquired a property interest to the following described real estate: Beginning at the Northeast Corner of the NE 1 /4 of the SE 1 /4 of Section 9, Township 91, Range 4 West of the 5th P.M., thence South 15 degrees West 2.55 chains, thence North 58 degrees West 2.5 chains, thence North 70 degrees 30 minutes West 75 links, thence North 49 degrees 30 minutes West to North line of said NE SE and thence East by line to point of beginning. Said parcel containing .5 acre more or less
WHEREAS, on August 25, 1982, the Clayton County Board of Supervisors held a public hearing for sale of said real estate to Eugene & Ruth Knospe and executed a deed for said property
WHEREAS, an error in the description was recently found and needs to be corrected by repeating the sale process
WHEREAS, in accordance with Chapter 331.361(2) of the CODE OF IOWA, 2005, notice of a public hearing is published in the Guttenberg Press on May 3, 2006, for a hearing to be held on May 10, 2006,
THEREFORE BE IT RESOLVED by the Board of Supervisors of Clayton County, Iowa, that the Board Chairman, Larry Gibbs, and County Auditor, Dennis Freitag, be authorized to execute a Correction Quit Claim Deed to Eugene & Ruth Knospe for said real estate.
Motion by Meyer, seconded by Walke, to approve resolution #17-2006 regarding a tobacco sale violation of DTM, Inc. d/b/a Fast Trak. Ayes: Walke, Meyer, Gibbs Resolution # 17-2006
WHEREAS, DTM, Inc., d/b/a Fast Trak has been charged with a complaint as a tobacco permit holder who sold, gave, or otherwise supplied tobacco, tobacco products, or cigarettes to a person under eighteen years of age,
WHEREAS, DTM, Inc. has agreed to pay a fine of $1,500,
THEREFORE BE IT RESOLVED by the Clayton County Supervisors that Larry Gibbs, Chairman, be authorized to enter into an acknowledgment/settlement agreement for a second violation in a year.
The board received the following certification of salary percentage of principal officer:
Whereas, Jeff Feldmann, Deputy Auditor, has completed successfully another six months of employment as deputy auditor, Therefore, I, Dennis Freitag, Clayton County Auditor, certify his salary percentage as 68.5% of the County Auditor’s salary effective on the payroll for March, 2006. This action is done in accordance with Chapter 331.904 of the Code of Iowa.
Motion by Meyer, seconded by Walke, to approve a diesel fuel contract with Fauser Oil Co. for delivery for Secondary Road department. Ayes: Walke, Meyer, Gibbs
