The Board of Supervisors of Clayton County, Iowa, met on March 8, 2006, at 10 o’clock, a.m., at the Board Office, Elkader, Iowa, for the purpose of setting a date for a public hearing on the designation of an urban renewal area and on a proposed urban renewal plan and project. The Chairperson presided and the roll being called, the following members of the Board were present and absent:

Present: Robert Walke, Neil Meyer, Larry Gibbs
Absent: None

The Chairperson announced that a plan had been prepared for a proposed project and that it was now necessary to set a date for a public hearing on the designation of the Clayton County Recycling Urban Renewal Area and on that plan and the project outlined therein. Accordingly, Supervisor Walke moved the adoption of the following resolution entitled “Resolution setting date for a public hearing on designation of the Clayton County Recycling Urban Renewal Area and on urban renewal plan and project,” and the motion was seconded by Supervisor Meyer.

Following due consideration, the Chairperson put the question on the motion and the roll being called, the following named Supervisors voted:

Ayes: Robert Walke, Neil Meyer, Larry Gibbs
Nays: None.

Whereupon, the Chairperson declared the resolution duly adopted, as follows:

RESOLUTION NO. 6-2006

Setting date for a public hearing on designation of the Clayton County Recycling Urban Renewal Area and on urban renewal plan and project

WHEREAS, a proposal has been submitted to the Board of Supervisors (the “Board”) of Clayton County (the “County”) under which an area within the boundaries set out in Exhibit A would be designated the Clayton County Recycling Urban Renewal Area (the “Urban Renewal Area”); and

WHEREAS, the Board is desirous of obtaining as much information as possible from the residents of the County before making this designation; and

WHEREAS, a proposed urban renewal plan for a project within that proposed designated area has been prepared and it is now necessary that a date be set for a public hearing on the designation of the area and on that plan and project; and

WHEREAS, the territory proposed for inclusion in the Urban Renewal Area lies within two miles of the cities of Luana and Monona, and pursuant to Section 403.17, it is necessary for the County to enter into a joint agreement with both of these cities in order to establish the Urban Renewal Area;

NOW, THEREFORE, Be It Resolved by the Board of Supervisors of Clayton County, Iowa, as follows:

Section 1. This Board will meet at the Board Office, Elkader, Iowa, on the 5th day of April, 2006, at 10 o’clock a.m., at which time and place it will hold a public hearing on the designation of the proposed Clayton County Recycling Urban Renewal Area described in the preamble hereof and on the proposed urban renewal plan and project for said Area.
Section 2. The County Auditor shall publish notice of said hearing, the same being in the form attached to this resolution, which publication shall be made in a legal newspaper of general circulation in Clayton County, which publication shall be not less than four (4) nor more than twenty (20) days before the date set for the hearing.


Section 3. The proposed urban renewal plan is hereby submitted to the County’s Plan and Zoning Commission for review and recommendations, as required by Section 403.5, Code of Iowa.
Section 4. The Joint Agreements, in substantially the form attached hereto, are hereby approved, the Chairperson and the County Auditor are hereby authorized to execute such agreements, and the County Auditor is hereby authorized to submit such agreements to the City Councils of the cities of Luana and Monona for approval.

Passed and approved March 8, 2006.

Motion by Walke, seconded by Meyer, to authorize the Chairman to execute a contract with Shawver Well Co., Fredericksburg, IA, for a VFD well pump system for the Clayton County Law Enforcement Center. Ayes: Walke, Meyer, Gibbs

Tim Engelhardt and Rafe Koopman discussed a proposed “Drug-free Workplace Policy”. Some changes were proposed and consensus was to more discussion and thought were needed before passage of this policy.

Motion by Walke, seconded by Meyer, to approve the minutes of February 27, March 1, 6, 8, 2006. Ayes: Walke, Meyer, Gibbs
