Meeting of the Board of Supervisors at their office, 200 E. Bridge St., Elkader, IA. Present: Robert Walke, Neil Meyer, Larry Gibbs
Motion by Walke, seconded by Meyer, to authorize the Chairman to execute a federal aid agreement for project BROS-CO22(46)—5F-22 (Canoe Road bridge replacement). Ayes: Walke, Meyer, Gibbs
Greg Hermiston, Medical Associates HMO, discussed the 2006 renewal of the Medical Associates HMO.
The Board of Supervisors of Clayton County, Iowa, met on March 29, 2006, at 11 o’clock, a.m., at the Board Office, Elkader, Iowa, for the purpose of setting a date for a public hearing on the designation of an urban renewal area and on a proposed urban renewal plan and project. The Chairperson presided and the roll being called, the following members of the Board were present and absent: Present: Robert Walke, Neil Meyer, Larry Gibbs Absent: None
The Chairperson announced that a plan had been prepared for a proposed project and that it was now necessary to set a date for a public hearing on the designation of the Clayton County Mining Urban Renewal Area and on that plan and the project outlined therein. Accordingly, Supervisor Neil Meyer moved the adoption of the following resolution entitled “Resolution setting date for a public hearing on designation of the Clayton County Mining Urban Renewal Area and on urban renewal plan and project,” and the motion was seconded by Supervisor Robert Walke.
Following due consideration, the Chairperson put the question on the motion and the roll being called, the following named Supervisors voted: Ayes: Robert Walke, Neil Meyer, Larry Gibbs Nays: None
Whereupon, the Chairperson declared the resolution duly adopted, as follows: RESOLUTION NO. 8-2006 Setting date for a public hearing on designation of the Clayton County Mining Urban Renewal Area and on urban renewal plan and project
WHEREAS, a proposal has been made which shows the desirability of designating a portion of Clayton County, Iowa (the “County”) as the Clayton County Mining Urban Renewal Area, pursuant to the provisions of Chapter 403, Code of Iowa; and
WHEREAS, a proposal has been submitted to the Board under which the real property (the ”Property”) lying within the boundaries set out in Exhibit A would be designated an urban renewal area; and
WHEREAS, this Board is desirous of obtaining as much information as possible from the residents of the County before making this designation; and
WHEREAS, a portion of the Property meets the definition of “agricultural land” under Section 403.17 of the Code of Iowa, and it is necessary to present agreements (the “Agricultural Land Agreements”) to the owners of such “agricultural land” in order to receive the consent required by said law; and
WHEREAS, a portion of the Property lies inside and within two miles of the incorporated limits of the City of Clayton, Iowa, and pursuant to Section 403.17 of the Code of Iowa, it is necessary for the County to enter into a joint agreement (the “Joint Agreement”) with the City of Clayton prior to the County including such property in an urban renewal area; and
WHEREAS, a proposed urban renewal plan for a project within that proposed designated area has been prepared and it is now necessary that a date be set for a public hearing on the designation of the area and on that plan and project;
NOW, THEREFORE, Be It Resolved by the Board of Supervisors of Clayton County, Iowa, as follows:
Section 1. This Board will meet at the Board Office, Elkader, Iowa, on the 26th day of April, 2006, at 11 o’clock a.m., at which time and place it will hold a public hearing on the designation of the proposed Clayton County Mining Urban Renewal Area described in the preamble hereof and on the proposed urban renewal plan and project for said Area.
Section 2. The County Auditor shall publish notice of said hearing, the same being in the form attached to this resolution, which publication shall be made in a legal newspaper of general circulation in Clayton County, which publication shall be not less than four (4) nor more than twenty (20) days before the date set for the hearing.
Section 3. Pursuant to Section 403.5 of the Code of Iowa, Carolyn Corbin of Upper Explorerland Regional Planning Commission is hereby designated as the County’s representative in connection with the consultation process which is required under that section of the urban renewal law.
Section 4. The proposed urban renewal plan is hereby submitted to the County’s Planning and Zoning Commission for review and recommendations, as required by Section 403.5, Code of Iowa.
Section 5. The County Auditor is hereby authorized and directed to present the Agricultural Land Agreements to the owners of such portions of the Property as meet the definition of “agricultural land” as described in the preamble hereof, such agreements to be executed and delivered to this Board on or before the public hearing on April 26, 2006. Section 6. The County Auditor is hereby authorized and directed to present the Joint Agreement to the City of Clayton, Iowa, such agreement to be executed and delivered to this Board on or before the public hearing on April 26, 2006.

Motion by Walke, seconded by Meyer, to authorize the Chairman to execute a contract for services with Upper Explorerland Regional Planning Commission to prepare an urban renewal plan for Clayton County Mining Urban Renewal Area. Ayes: Walke, Meyer, Gibbs
Motion by Meyer, seconded by Walke, to approve the minutes of March 13, 15, 22, 27 and 29, 2006. Ayes: Robert Walke, Neil Meyer, Larry Gibbs
