Meeting of the Board of Supervisors at their office, 200 E. Bridge St., Elkader, IA.

Present:  Robert Walke, Neil Meyer, Larry Gibbs

 

A public hearing was held regarding a proposed resolution for the sale of the old jail property.  There were ten people in attendance and all were in favor of the proposed resolution.  Discussion was held about protections to both sides, the county and the purchaser, that the restoration work will be done and the purchaser has protection that good faith performance will be satisfactory. The purchaser will pay for a survey of the property and any legal costs.

 

Motion by Walke, seconded by Meyer, to approve the proposed resolution regarding the sale of the old county jail property.  Ayes:  Walke, Meyer, Gibbs

Resolution # 22-2006

 

WHEREAS, Clayton County has constructed a new jail and Sheriff’s office and the current jail and Sheriff’s office will be vacated and available for sale,

 

WHEREAS, the Clayton County Board of Supervisors has received an offer from JACK Management, LLC of Elkader, Iowa, for the purchase of the jail and Sheriff’s office located in the City of Elkader,

 

WHEREAS, the Clayton County Board of Supervisors has determined that the jail property in the City of Elkader cannot serve any useful purpose for the benefit of the County and that the maintenance costs of the facility is greater than any benefit that may be derived from continued ownership of the facility,

 

NOW, BE IT RESOLVED, by the Clayton County Board of Supervisors, as follows:

  1. The offer for the purchase of the jail and Sheriff’s office located in the City of Elkader in the amount of $350 from JACK Management, LLC of Elkader, Iowa, should be accepted subject to a reversionary interest held by Clayton County, Iowa.

  2. The jail property may be generally described as:

Part of Lot Seven (7) of Government Lot Two (2) in Section Twenty-three (23) of Township 93 North , Range 5 West of the 5th P.M. in the City of Elkader of Clayton County, Iowa, and consisting of approximately 3.52 acres, more or less.

  1. The foregoing description is subject to change pursuant to a plat and survey of the property that shall be accomplished at the expense of the purchaser.

  2. The foregoing jail property shall be sold “as is” with no warranties whatsoever and the property shall be transferred by a Quit Claim Deed without the County being required to furnish an Abstract of Title to said property.

  3. The sale and transfer of the property to JACK Management, LLC, shall be subject to the following conditions that the purchaser must perform and in the event the purchaser does not perform, the title to the real estate shall revert to Clayton County, as follows:

    1. Return the front porch and balcony to original design and remove fire escape;

    2. Rebuild the four chimneys;

    3. Remove the old school house;

    4. Remove the cell block drop ceiling and expose the second story cells;

    5. Restore the kitchen to period look with today’s efficient appliances and period furnishings;

    6. Create 19th century appeal using period furnishings, memorabilia, photos, etc.

    7. Strip the first floor woodwork to original;

    8. Create botanical garden with gazebo for music, weddings, picnics, etc;

    9. Establish an area to highlight the nine County museums.

  4. The foregoing is subject to a public hearing and any objections that may be raised to the foregoing sale and purchase with the Board of Supervisors reserving the right to reject the bid made by JACK Management, LLC.

  5. Notice of the foregoing resolution shall be published in accordance with applicable law.

Motion by Meyer, seconded by Walke, to accept the bid of Peterson Contractors, Inc. for $63,380 for project L-FEMA-06 Rip Rap.  Ayes:  Walke, Meyer, Gibbs

 

Motion by Walke, seconded by Meyer, to approve a fireworks permit to Brainards’ Country Change, LLC, for July 28, 2006.  Ayes:  Walke, Meyer, Gibbs

 

Motion by Walke, seconded by Meyer to approve a resolution approving a towerspace agreement between Clayton County, Iowa and Dairyland Power Cooperative.  Ayes: Walke, Meyer, Gibbs

Resolution # 23-2006

WHEREAS, the political jurisdiction of Clayton County has the authority under statue to enter into agreements with both private and public entities; and

 

WHEREAS, the County desires to use Dairyland’s Cassville tower facility to upgrade its radio communication services to its eastern border communities of Clayton, Guttenberg, North Buena Vista, etc.

 

NOW THEREFORE, be it resolved by the Board of Supervisors of Clayton County to approve and enter into the attached agreement, as amended.

 

Motion by Meyer, seconded by Walke to approve a resolution adopting the Iowa

Mutual Aid Compact .  Ayes:  Walke, Meyer, Gibbs

 

Resolution # 24-2006

WHEREAS, emergencies and disasters transcend jurisdictional boundaries, making intergovernmental coordination essential in successful emergency response efforts; and

 

WHEREAS, there will inevitably be emergencies which require immediate access to outside resources due to the fact that few individual governments have all of the resources they may need in every type of emergency; and

 

WHEREAS, Senate File 2124, approved by the Second Session of the 79th General Assembly in 2002, creates Iowa Code section 29C.22,  the Statewide Mutual Aid Compact (attached); and

 

WHEREAS, the Statewide Mutual Aid Compact allows participating counties, cities and other political subdivisions to provide in advance for mutual assistance in managing any emergency or disaster; 

 

THEREFORE, BE IT RESOLVED BY THE BOARD SUPERVISORS OF CLAYTON COUNTY that in order to maximize the prompt, full and effective use of resources of all participating governments in the event of an emergency or disaster, the County hereby adopts the Statewide Mutual Aid Compact which is attached hereto and incorporated by reference.

 

Motion by Walke, seconded by Meyer, to approve a resolution adopting and implementing the National Incident Management System (NIMS).  Ayes:  Walke, Meyer, Gibbs

 

Resolution # 25-2006

 

WHEREAS, Homeland Security Presidential Directive / HSPD-5, 28 Feb 2003

established the National Incident Management System (NIMS); and

 

WHEREAS, the NIMS establishes a single, comprehensive approach to domestic

incident management to ensure that all levels of government across the Nation have the

capability to work efficiently and effectively together using a national approach to domestic incident management; and

 

WHEREAS, the NIMS provides a consistent nationwide approach for Federal, State, and

local governments to work together to prepare for and respond to, and recover from domestic incidents regardless of the cause, size or complexity; and

 

WHEREAS, the NIMS provides for interoperability and compatibility among Federal,

State and local capabilities and includes a core set of concepts, principles, terminology and technologies covering the incident command system, unified command, training, management of resources and reporting; and

 

WHEREAS, beginning October 1, 2004 all Federal departments and agencies shall make

adoption of the NIMS a requirement, to the extent provided by law, for providing Federal

preparedness assistance through grants, contracts or other activities to local governments;

 

NOW THEREFORE, be it resolved that Clayton County, Iowa and its emergency related departments hereby resolve to:

  1. Adopt the National Incident Management System (NIMS) as its system of preparing for and responding to disaster incidents;

  2. Support and participate in Clayton County’s multi-agency coordination system by using the County’s Emergency Operations Center (EOC); Mobile Incident Command Post, and/or 911 Communications/Dispatch Center as need arises;

  3. Support and participate in Clayton County’s multi-agency public information system (i.e., Joint Information System and Joint Information Center) to communicate emergency information to the public;

  4. Develop an internal process to direct federal preparedness funding to locally implement the National Incident Management System (i.e., NIMS);

  5. Revise county emergency plans, policies, mutual aid agreements, and associated documents to ensure the use of NIMS and ICS concepts and terminology in emergency planning and response activities;

  6. Join the Iowa Mutual Aid Compact and other mutual aid agreements as appropriate;

  7. Direct that appropriate county officers and employees be trained in the use of NIMS and ICS concepts, practices, and procedures;

  8. Conduct, or participate in, an annual exercise (i.e., tabletop, functional or full-scale) incorporating National Incident Management System, Incident Command System, Multiple Agency Coordination System (MACS), and Joint Information System (JIS) concepts and practices;

  9. Classify and inventory local resources according to federally prescribed standards; and

  10. Utilize plain language when involved in an emergency event involving two or more emergency response agencies.

Motion by Walke, seconded by Meyer, to approve a resolution designating the IMAC authorized representatives and designated contacts for Clayton County, Iowa.  Ayes:  Walke, Meyer, Gibbs

 

Resolution # 26-2006

 

WHEREAS, the political jurisdiction of Clayton County has adopt the National Incident Management System (NIMS) and its related elements as its system of preparing for and responding to disaster incidents; and

 

WHEREAS, the County has joined the Iowa Mutual Aid Compact (IMAC) in support of the its emergency management and homeland security responsibilities; and

 

WHEREAS, as part of affiliating with IMAC, the County must designate a number of individuals to function as IMAC authorized representatives and designated contacts; and

 

WHEREAS, the authorized representative(s) is authorized to obligate funds and personnel on behalf of Clayton County, and the designated contact(s) is authorized to coordinate resources and personnel in response to an IMAC request.

 

NOW THEREFORE, be it resolved by the Board of Supervisors of Clayton County that those authorized representatives and designated contacts shall be:
