Meeting of Board of Supervisors in their office, 200 E. Bridge St., Elkader, IA. Present: Walke, Meyer, Gibbs
Quotes were received from Brown’s Sales & Leasing and Rodas Chevrolet, Inc. on purchase of a 2005 large extended cab, 4 wheel drive, diesel pickup and a 2005 mid-size 4 door utility vehicle with 4 wheel drive as follows:
Motion by Walke, seconded by Gibbs, to accept the quote of Brown’s Sales and Leasing for a pickup at $27,760 and the quote of Rodas Chevrolet, Inc. for the utility vehicle $22,649. Ayes: Walke, Meyer, Gibbs
Minutes of the March 8, 2005, Planning & Zoning Board meeting and the maps of the areas to be discussed were presented by Mike Oberbroeckling, Zoning Administrator, to the Board of Supervisors before the following hearings began.
A public hearing was held regarding a rezoning request from A-1 to C-1 for Duane & Lorraine Dittmer in Section 20 & 29, of Cox Creek Township. The use that Mr. Dittmer is requesting is to be able to charge rental fees for camping and the visitation & use of the property for recreational activities. The Planning and Zoning Board suggested that the C-1 use is too broad a use of the property and approved a zoning change to R-4 which is closer to the proposed use. Alan Schantz expressed a concern about the level B road that is near the property regarding transporting hay and meeting a recreational vehicle at the same time. Motion by Walke, seconded by Gibbs, to approve the Planning & Zoning Board’s decision of rezoning from A-1 to R-4 the property requested by Duane & Lorraine Dittmer in section 20 & 29 of Cox Creek Township with the concerns expressed noted. Ayes: Walke, Meyer, Gibbs
A public hearing was held regarding a rezoning request from A-1 to C-1 for Steven Hansel in Section 34 of Garnavillo Township. Concern was expressed about the driveway in the property, 911 signage and traffic safety by Milo Rolfe as well as at the Planning and Zoning Board meeting. Motion by Walke, seconded by Gibbs, to approve the Planning and Zoning Board’s recommendation of rezoning from A-1 to C-1 for Steve Hansel in section 34 of Garnavillo Township with the concerns expressed noted. Ayes: Walke, Meyer, Gibbs
A public hearing was held on final plat approval for Breezy Pointe Subdivision owned by Bill Burke in section 20 & 21 and Basil Giard Land Claim. Ron Kleinow stated that he was taping this hearing for possible litigation purposes. A concern was expressed by Harlan Dettman and Ron Kleinow regarding the current zoning status. Motion by Walke, seconded by Gibbs, to recess this hearing until March 14 at 10:30 AM until further information can be found. Ayes: Walke, Meyer, Gibbs
A public hearing was held on final plat approval for Emerald Valley Estates Subdivision owned by George Leonard in sections 9 & 10 of Cox Creek Township. Ron Kleinow stated that he was also taping this hearing for possible litigation purposes. Motion by Gibbs, seconded by Walke, to approve the final plat of Emerald Valley Estates Subdivision as recommended by the Planning & Zoning Board. Ayes: Walke, Meyer, Gibbs
Bids accompanied by bid bonds were received on project L-1627(1) grading as follows:
A public hearing was held regarding final plat approval for River Bluffs Resort subdivision owned by Witter, Schultz and River Bluffs Resort, LLC. Ron Kleinow stated that he was also taping this hearing for possible litigation purposes. Mike Oberbroeckling, Zoning Administrator, reviewed the items of concern in the minutes of the Planning and Zoning Board of March 8, 2005. Concerns were the length of cul-de-sac, lot and building lines and open spaces requirements meeting the ordinance. Another concern was whether this plat is even a subdivision since it is platted as only one lot. The definition of “street” in reference to the cul-de-sac in the ordinance was reviewed by the Board of Supervisors and Harlan Dettman and Jerald Thomas. A letter was read from Jim Daughtry regarding concerns of Kathy Koether, member of the Planning and Zoning Board, participation as a conflict of interest since her husband is one of the litigants to stop the River Bluffs Resort project. It was the opinion of the Ombudsman of the State of Iowa that it was a conflict of interest exists with her participation in the matters of the Planning and Zoning Board regarding River Bluffs Resort. This letter was also presented to the chairman of the Planning and Zoning Board prior to the March 8th meeting.
Motion by Walke, seconded by Gibbs, to recess this hearing until March 14 at 10:30 AM until further information can be found. Ayes: Walke, Meyer, Gibbs
Motion by Gibbs, seconded by Walke, to accept the low bid on project L-1627(1) grading of Riehm Construction in the amount of $11,606. Ayes: Walke, Meyer, Gibbs
Dave Burris and Cindy Crow met with the board to discuss the county secondary road brush clearing program in the road right-of-way in their area. The debris from cutting is left behind to decay and poses problems with unsightliness in regard to tourism and in general, additional debris in heavy rains to plug culverts and safety dangers for ATV and snowmobiles during winter. They would like the debris chipped/removed or change the program to a chemical application program. The board said they would discuss with the Co. Engineer about the situation.
Motion by Gibbs, seconded by Meyer, to approve the minutes of February 28, March 7 and 9. Ayes: Walke, Meyer, Gibbs
