Meeting of Board of Supervisors in their office, 200 E. Bridge St., Elkader, IA. Present: Walke, Meyer, Gibbs
Joel Biggs was present with the minutes of the Planning & Zoning Board and applicable maps regarding the following hearings.
A public hearing was held regarding a rezoning request from A-1 to C-1 for Duane & Lorraine Dittmer in Section 20 & 29, of Cox Creek Township. The use that Mr. Dittmer is requesting is to be able to charge rental fees for camping and the visitation & use of the property for recreational activities. The Planning and Zoning Board suggested that the C-1 use is too broad a use of the property and approved a zoning change to R-4 which is closer to the proposed use. There were no objectors present. Motion by Walke, seconded by Gibbs, to approve the zoning request on the property requested by Duane & Lorraine Dittmer in section 20 & 29 of Cox Creek Township, waive the third hearing and amend the zoning ordinance map. Ayes: Walke, Meyer, Gibbs
A public hearing was held regarding a rezoning request from A-1 to C-1 for Steven Hansel in Section 34 of Garnavillo Township. There were no objectors present. Motion by Gibbs, seconded by Walke, to approve the Planning and Zoning Board’s recommendation of rezoning from A-1 to C-1 for Steve Hansel in section 34 of Garnavillo Township, waive the third hearing and amend the zoning ordinance map. Ayes: Walke, Meyer, Gibbs
A public hearing was held on final plat approval for Breezy Pointe II Subdivision owned by Bill Burke in section 20 & 21 and Basil Giard Land Claim. The minutes of March 9th regarding this same plat should have read Breezy Pointe II instead of Breezy Pointe. Ron Kleinow stated that he was taping this hearing for possible litigation purposes. Mr. Walke reported on prior zoning and plat approvals for Bill Burke as recorded in the Board of Supervisors minutes. Joel Biggs stated that that those actions are correctly stated on this plat. Ron Kleinow asked whether there are provisions to take lots from a prior plat and place them in a new plat. Harlan Dettman was questioning the number of acres of zoning in the prior and current plats. Frank Phippen stated that the entire area was rezoned in a prior year and there is nothing in our platting ordinance that prohibits or allows to take parcels from one plat to a new plat. Motion by Walke, seconded by Gibbs, to approve the final plat for Breezy Pointe II Subdivision owned by Bill Burke in section 20 & 21 and Basil Giard Land Claim of the first hearing that was recessed. Ayes: Walke, Meyer, Gibbs Ron Kleinow stated that set back lines are not on the plat. Motion by Walke, seconded by Gibbs to approve the second reading of the final plat for Breezy Pointe II Subdivision owned by Bill Burke in section 20& 21 and Basil Giard Land Claim and waive the third hearing. Ayes: Walke, Meyer, Gibbs
A public hearing was held on final plat approval for Emerald Valley Estates Subdivision owned by George Leonard in sections 9 & 10 of Cox Creek Township. Ron Kleinow stated that he was also taping this hearing for possible litigation purposes. He also stated that set back lines are not on the plat. Motion by Gibbs, seconded by Walke, to approve the final plat of Emerald Valley Estates Subdivision as recommended by the Planning & Zoning Board and waive the third hearing. Ayes: Walke, Meyer, Gibbs
The first public hearing was reconvened regarding final plat approval for River Bluffs Resort subdivision owned by Witter, Schultz and River Bluffs Resort, LLC. Ron Kleinow stated that he was also taping this hearing for possible litigation purposes. Greg Koether stated he felt that an inaccuracy exists in the letter from the Jim Daughtry with the plat that should be reconsidered by the Planning and Zoning Board. Motion by Walke, seconded by Gibbs, to not consider this application today, but send it back to the Board of Adjustment in regards to side yard requirements and the Planning and Zoning Board in regards to variances as it relates to subdivision regulations. Also, to review a revised plat including lot designations. Ayes: Walke, Meyer, Gibbs
The second public hearing for this final plat approval was convened. Motion by Walke, seconded by Gibbs, to not to consider this application today, but send it back to the Board of Adjustment in regards to side yard requirements and the Planning and Zoning Board in regards to variances as it relates to subdivision regulations. Also, to review a revised plat including lot designations. Ayes: Walke, Meyer, Gibbs
A budget amendment hearing on the county’s fiscal year ending June 30, 2005, was held as published. Motion by Walke, seconded by Gibbs, to approve the budget amendment as published to the county’s fiscal year ending June 30, 2005, budget. Ayes: Walke, Meyer, Gibbs
A budget hearing on the county’s fiscal year ending June 30, 2006, was held as published. Motion by Gibbs, seconded by Walke, to approve the county budget as published to the county’s fiscal year ending June 30, 2006, and approve the compensation board recommendation for fiscal year ending June 30, 2006. Ayes: Walke, Meyer, Gibbs
