Meeting of the Board of Supervisors at their office, 200 E. Bridge St., Elkader, Iowa.

Present:  Robert Walke, Neil Meyer, Larry Gibbs

 

The board approved claims for payment.

 

Motion by Gibbs, seconded by Walke, to approve renewal of cigarette permits to Kwik Trip, Inc. and DTM, Inc. for fiscal year ending June 30, 2006.  Ayes:  Walke, Meyer, Gibbs

 

Motion by Gibbs, seconded by Walke, to approve resolution #18-2005 regarding an appropriations change.  Ayes:  Walke, Meyer, Gibbs

 

RESOLUTION # 18-2005

 

WHEREAS, it is necessary to make appropriation changes to the various departments for the legal expenditure of funds due to end of the year adjustments,

 

THEREFORE BE IT RESOLVED by the Board of Supervisors of Clayton County, Iowa, that the following appropriation changes are made to the respective department for fiscal year ending June 30, 2005 as adopted by budget amendments and as presented in the following table:

A public hearing regarding the final plat of the Top of the Rainbow subdivision was held which was delayed from June 6, 2005, with no objectors present or comments heard. 

Motion by Walke, seconded by Gibbs, to approve resolution # 19-2005 regarding the final plat of Top of the Rainbow subdivision.  Ayes:  Walke, Meyer, Gibbs

 

Resolution # 19-2005

Approving the final plat of Top of the Rainbow subdivision

 

WHEREAS, there has been submitted to the Board of Supervisors of Clayton County, Iowa, a plat of real property hereinafter designated as Top of the Rainbow Subdivision and described as a part of the NW ¼ SW ¼ Section 21, Township 92 North, Range 4 West of the 5th P.M.,

 

WHEREAS, Dean and Sandra Refle as owners of said real property, have executed and acknowledged an instrument consenting to said plat,

 

WHEREAS, it appears that said plat complies with all requirements of Chapters 354 and 255 of the Code of Iowa,

 

WHEREAS, the Clayton County Planning and Zoning Commission has recommended approval of said subdivision, affirming that it has complied with all the regulations of Clayton County, Iowa,

 

THEREFORE BE IT RESOLVED by the Clayton County Board of Supervisors that the Board approves as an official subdivision, the plat of real property to be known as Top of the Rainbow subdivision, (approximately 31.94 acres excluding right of way) situated in Clayton County, Iowa, and described as: a part of the NW ¼ SW ¼ Section 21, Township 92 North, Range 4 West of the 5th P.M.

 

Ed Olson presented a possible program regarding a rural heritage preservation program and grant through the Iowa Historical Preservation Commission.

 

Motion by Gibbs, seconded by Walke, to approve a contract of services with Northeast Iowa Mental Health Center for $63,189.  Ayes:  Walke, Meyer, Gibbs

 

Further discussion was held with Sandy Seifert, Scenic Acres Administrator, Connie Ruhser, Scenic Acres Accounting Dept, and Jean Gage, Clayton County CPC, regarding funding with Scenic Acres. The June grant payment to be paid in July will be forgiven with a review in December. 

 

Motion by Walke, seconded by Gibbs, to approve the fireworks permit to the Clayton County Fair for August 5th.  Ayes:  Walke, Meyer, Gibbs

 

Trisha Wilkens, Upper Explorerland Regional Planning Commission, presented documents to be on file in the County Auditor’s Office regarding environmental and historical impact of demolition properties in Elkport, Garber and rural Clayton County because of the 2004 flood.

 

Kevin Clefisch, County Attorney, was present to discuss county ordinance recodification. 

The board discussion included the possible repeal of the zoning ordinance and allowing state law to prevail, changing to a planned unit development procedure or making selected deletions that are redundant because of other methods of regulation or contradictory were possible directions to follow.     

 

Motion by Gibbs, seconded by Walke, to sign a revised contract for services with Cost Advisory Services, Inc. Ayes:  Walke, Meyer, Gibbs
