A public hearing was held on a proposed resolution regarding the transfer of interest in vacated road right of way in Section 21 of Volga Township. No objections or comments were heard.
Motion by Walke, seconded by Gibbs to approve resolution # 9-2005 regarding the transfer of interest in vacated road right of way in Section 21 of Volga Township to Jeffrey & Darcy Bolsinger. Ayes: Walke, Meyer, Gibbs
RESOLUTION # 9-2005
WHEREAS, Clayton County, has a property interest to the following described real estate:
Part of the NW¼ SW¼ of Section 21, Township 92 North, Range 4 West of the 5th PM, Clayton County, Iowa, containing 0.92 acres, more or less, and more particularly described by metes and bounds as follows:
Commencing at the West ¼ Corner of Section 21, Township 92 North, Range 4 West of the 5th PM; thence S 00 degrees-04’-47” E, 1337.92 feet along the west line of the SW¼ of said Section 21; thence N 89 degrees-11’-01” E, 682.09 feet along the south line of the NW¼ SW¼ of said Section 21 to the Point of Beginning; thence N89 degrees-11’01” E, 90.62 feet along the south line of said NW¼ SW¼ ; thence N 05 degrees-54’-43” E, 342.26 feet along the westerly right-of-way line of Clayton County Highway No. X3C; thence N 18 degrees-39’-12” W, 81.54 feet along said right-of-way line; thence N 18 degrees-50’-44” W, 110.36 feet along said right-of-way line: thence S 68 degrees-26’-01” W, 11.14 feet; thence S 05 degrees-54’-43” W, 522.11 feet to the Point of Beginning. Said described parcel contains 0.92 acres, more or less. The west line of the SW¼ of Section 21, T92N, R4W is assumed to bear S 00 degrees-04’-47” E.
WHEREAS, the property has been deemed as excess road right of way,
WHEREAS, a vacation hearing notice was published and hearing held on March 28, 2005,
WHEREAS, this section of right of way was vacated by the Clayton County Board of Supervisors,
WHEREAS, in accordance with Chapter 331.361(2) of the CODE OF IOWA, 2003, notice of a public hearing is published in the Clayton County Register on April 20, 2005, for a hearing to be held on April 25, 2005,
THEREFORE BE IT RESOLVED by the Board of Supervisors of Clayton County, Iowa, that the Board Chairman, Neil Meyer, and County Auditor, Dennis Freitag, be authorized to execute a quit claim deed to Jeffrey S. and Darcy L. Bolsinger for said real estate.
Motion by Gibbs, seconded by Walke, to approve the renewal of a beer-wine carry out permit and Sunday sales permit to DTM, Inc. dba Fast Trak. Ayes: Walke, Meyer, Gibbs
Motion by Walke, seconded by Gibbs, to approve payment of a claim from the Secondary Road fund. Ayes: Walke, Meyer, Gibbs
The Board received bids for delivery of fuel for Secondary Road department for May 1, 2005 to April 30, 2006. Motion by Walke, seconded by Gibbs, to award Fauser Oil Item #1 at $.079 per gallon and to award Three Rivers FS Item #2 at $.0371 per gallon for premium diesel fuel and $.0626 per gallon for Artic fuel. Ayes: Walke, Meyer, Gibbs
Motion by Gibbs, seconded by Walke, to approve resolution # 10-2005 regarding the transfer of interest in vacated road right of way in Section 26 of Volga Township to Gary & Ann Armstrong. Ayes: Walke, Meyer, Gibbs
Resolution # 10-2005
WHEREAS, Clayton County, held road vacation hearings on December 8 and 10, 2003, regarding the following described road right of way:
Third Street lying on the north line of Block 3 and south line Lot 17 of Block 6, Stroschein’s Addition, beginning on the east line of Riverview Street and continuing easterly to the right of way line of county road X3C. Said street located in Section 26, Township 92 North, Range 4 West 5th P.M.
WHEREAS, the property interest has been deemed as surplus and Gary & Ann Armstrong have expressed interest in the real estate as their property is adjacent to it,
WHEREAS, in accordance with Chapter 331.361(2) of the CODE OF IOWA, 2003, notice of a public hearing is published in the Clayton County Register on April 20, 2005, for a hearing to be held on April 25, 2005,
THEREFORE BE IT RESOLVED by the Board of Supervisors of Clayton County, Iowa, that the Board Chairman, Neil Meyer, and County Auditor, Dennis Freitag, be authorized to execute a Quit Claim Deed to Gary & Ann Armstrong for said real estate.
Motion by Gibbs, seconded by Walke, to approve resolution # 11-2005 regarding advertisement of a road vacation for Ron Kulper in Millville Township. Ayes: Walke, Meyer, Gibbs
Resolution #11-2005
WHEREAS, a request has been presented to the Clayton County Board of Supervisors asking that action be taken to vacate and close a section of Clayton County Secondary Road, described as follows:
To vacate approximately 0.23 acres of excess right of way known as Lot 4 of Government Lot 8 located in the SW ¼ SE ¼ in section 11, Township 91 North, Range 2 West of the 5th P.M. in Clayton County, Iowa. Said right of way is a portion of Project GRS-1715(1)-62-22.
THEREFORE BE IT RESOLVED that a hearing on the proposed vacation will be held in the Board of Supervisors Office, 200 East Bridge St, Elkader, Iowa, on May 4, 2005 at 11:00 AM in accordance with Iowa Code Chapter 306.
