SOLID WASTE CONTROL ORDINANCE

 

TITLE:  An Ordinance Establishing Solid Waste Control in Clayton County, Iowa.

 

BE IT ENACTED BY THE CLAYTON COUNTY BOARD OF SUPERVISORS to make known the following:

 

Section 1. PURPOSE: The purpose of this ordinance is to control solid waste in the unincorporated area of Clayton County.

 

Section 2. DEFINITIONS: For clarification in this ordinance, certain terms or words used herein shall be interpreted or defined as follows:

  1. solid waste;  means garbage, refuse, rubbish, yard wastes, and other similar discarded solid or semi-solid materials, including, but not limited to such materials resulting from commercial, agriculture, and domestic activities.

  2. yard waste;  means organic debris, grass clippings, leaves, garden waste, flowers, bark, etc.  Yard waste may also include brush and tree limbs; however, those items MUST be chipped.  Chipped wood may then be combined with other yard waste which is produced as part of yard and garden development and maintenance.

  3. compost;  means organic material resulting from biological decomposition of waste which can be used as a soil conditioner or soil amendment.

  4. Board; means the Board of Supervisors of Clayton County, Iowa.

  5. licensed collection hauler;  means the person or firm Clayton County contracts with to dispose of Clayton County's solid waste and yard waste.     

  6. resident;  means individual, corporation, firm, agency, partnership, or association who owns, rents, or leases property in the unincorporated area of Clayton County.

Section 3. SEPARATION OF YARD WASTE:  All yard waste to be accepted by the licensed collection hauler shall be separated by the resident from all other garbage and refuse accumulated on the premises.  If not composted, yard waste must be placed in containers acceptable to the licensed collection hauler.

 

Section 4. MANNER/FREQUENCY OF COLLECTION:  All solid waste shall be collected at specific locations in Clayton County, as frequently as may be necessary in order to meet the needs of Clayton County residents.  All yard waste shall be collected at specific locations in Clayton County, from residential, commercial, industrial, and institutional premises as frequently as may be dictated by use of the service by Clayton County residents of the unincorporated area.

 

Section 5. YARD WASTE CONTAINERS:  Persons choosing not to compost yard waste on their own property may place yard waste in specially marked containers dispensed and/or approved by the licensed collection hauler.

 

Section 6. COMPOSTING AS ALTERNATIVE DISPOSAL:  Any  resident of private property may compost yard waste originating on their property, but MUST follow applicable rules of the Department of Natural Resources, as outlined in Chapter 105 of Administrative Rules.

 

Section 7. REPORT: The licensed collection hauler shall submit a written report annually to Clayton County detailing the amount of yard waste collected and delivered.

 

Section 8. EFFECTIVE DATE:  This ordinance shall be in effect from the date of the publication following the required public hearings.

 

Section 9. PENALTIES:  Any violation of this ordinance shall be a simple misdemeanor, punishable by a fine not to exceed $100.00.

 

Section 10. SEVERABILITY:  If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional, such decision shall not affect the validity of parts thereof NOT adjudged invalid or unconstitutional.
